Agreement to Our Legal Terms
We are JTE Home Agency LLC, a Michigan limited liability company, doing business as Mission Home Help (“Company,” “we,” “us,” or “our”). We operate the website missionhomehelp.com (the “Site”) and provide services related to the Michigan Medicaid Home Help Program, including helping families determine eligibility, completing CHAMPS Provider Enrollment with the Michigan Department of Health and Human Services (MDHHS), and employing approved caregivers as W-2 employees of our agency (collectively, the “Services”).

These Terms of Service (“Terms” or “Legal Terms”) form a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and JTE Home Agency LLC, concerning your access to and use of our Services. By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.
The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use the Services or submit any forms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site with a new “Last Updated” date. Your continued use of the Services after the effective date of any changes constitutes acceptance of those changes. We recommend that you save or print a copy of these Terms for your records.

1. Our Services
Mission Home Help is an enrolled Michigan Medicaid Home Help provider. Our Services include:
- Helping Michigan families determine whether they may qualify for the Michigan Home Help Program
- Assisting with Michigan Medicaid applications and the CHAMPS Provider Enrollment process with MDHHS
- Employing approved family caregivers as W-2 employees of our agency
- Processing payroll, tax withholding, and workers' compensation coverage for caregivers we employ
- Coordinating with MDHHS for caregiver enrollment, care assessments, and billing
- Providing ongoing support to caregivers and care recipients enrolled in the program
The Services are available only to individuals located in the State of Michigan, including individuals seeking care under the Michigan Home Help Program and individuals who may become caregivers under that program. Our Services are intended only for use in the State of Michigan and are not directed to users in other jurisdictions.
The information provided through the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation. Persons who choose to access the Services from other jurisdictions do so on their own initiative and are responsible for compliance with local laws.
2. Eligibility and Program Determinations
Our Services help you understand whether you may qualify for the Michigan Home Help Program and help you complete the enrollment process. However, final eligibility, program authorization, and service hours are determined solely by the Michigan Department of Health and Human Services (MDHHS) based on its assessment criteria and state guidelines. We do not make eligibility determinations, and we do not guarantee enrollment, approval, or any specific number of authorized care hours.
Eligibility for the Michigan Home Help Program is governed by Michigan Medicaid rules, MDHHS policy, and applicable state and federal law. These rules may change over time. We will use commercially reasonable efforts to keep information on our Site accurate and up to date, but we make no warranty that any information on the Site reflects the most current MDHHS rules.
By submitting an eligibility inquiry or other form through our Site, you understand that:
- Our preliminary review of your information does not guarantee MDHHS approval
- MDHHS may require additional documentation, assessments, or verifications before approving enrollment
- Caregiver pay, authorized hours, and other program terms are determined by MDHHS and applicable program rules
- We may decline to provide Services to any individual at our sole discretion, including for reasons related to background checks, MDHHS exclusion lists, geographic service area, or operational capacity
3. No Medical, Legal, or Financial Advice
The content on our Site is provided for general informational purposes only and does not constitute medical, legal, tax, or financial advice. Our Services do not include medical care, skilled nursing services, or any service that requires a healthcare license that we do not hold. We do not provide legal advice regarding Medicaid eligibility, estate planning, public-benefits planning, or any other legal matter. We do not provide tax advice regarding your obligations as a Medicaid recipient or as a W-2 employee.
For specific medical, legal, tax, or financial questions, you should consult a qualified professional. Nothing on our Site creates a doctor-patient, attorney-client, accountant-client, or fiduciary relationship.
4. User Representations
By using the Services, you represent and warrant that:
- You have the legal capacity to agree to these Terms
- You are at least 18 years old
- You are not a person prohibited from receiving services under U.S. law or any applicable Medicaid program rule
- You will not access the Services through automated or non-human means, including bots, scripts, or scrapers
- You will not use the Services for any illegal or unauthorized purpose
- Your use of the Services will not violate any applicable law or regulation
- Information you provide to us is true, accurate, current, and complete to the best of your knowledge
If you submit information on behalf of another person (for example, on behalf of an aging parent who will be the care recipient), you represent and warrant that you have the legal authority to submit that information on their behalf, including any authority required under applicable healthcare privacy laws.
If we discover that information you have provided is untrue, inaccurate, incomplete, or fraudulent, we reserve the right to refuse current or future Services, terminate your enrollment, and report the matter to MDHHS, law enforcement, or other appropriate authorities.
5. Accuracy of Information
You agree to provide accurate, current, and complete information when interacting with our Services, including on eligibility forms, employment applications, and any documentation required for CHAMPS Provider Enrollment or Medicaid billing. Misrepresentation of information may constitute Medicaid fraud, which is a serious offense under federal and Michigan law and may result in:
- Denial of enrollment in the Michigan Home Help Program
- Termination of Services
- Civil or criminal penalties imposed by federal or state authorities
- Exclusion from future participation in Medicaid programs
You agree to promptly notify us of any changes to information you have previously provided, including changes in the care recipient's living situation, Medicaid status, or care needs, and changes to a caregiver's address, banking information, or work authorization.
6. Prohibited Activities
You may not use the Services for any purpose other than that for which we make the Services available. You agree not to:
- Submit false, misleading, or fraudulent information on any form
- Impersonate any other person or misrepresent your relationship to a care recipient
- Use the Services to commit Medicaid fraud or any other fraud
- Use any automated system, bot, scraper, or other tool to access the Site or extract data
- Interfere with, disrupt, or attempt to bypass any security feature of the Site
- Reverse engineer, decompile, or attempt to extract source code from the Site
- Use the Site to transmit viruses, malware, or other harmful code
- Harass, threaten, or abuse our employees, contractors, or other users
- Use any information obtained through the Services to contact, solicit, or harm any caregiver, care recipient, or family member
- Attempt to compete with us or use information from the Site for any competitive purpose
- Copy, reproduce, distribute, or create derivative works of any content on the Site without our express written permission
- Use the Services in any manner that violates federal or Michigan law
7. Intellectual Property
We own or license all content on the Site, including text, graphics, logos, images, audio, video, software, design, and the “Mission Home Help” name and logo (collectively, the “Content”). The Content is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content on the Site for your personal, non-commercial use. You may not:
- Copy, modify, distribute, publish, or sell any Content
- Use the Content to train any machine learning or artificial intelligence model
- Use any of our trademarks or branding without our express written permission
- Frame, embed, or republish the Site or any portion of it without our express written permission
All rights not expressly granted to you in these Terms are reserved by us.
If you submit any feedback, suggestions, comments, or ideas to us about the Services (“Submissions”), you agree that we may use, reproduce, modify, and incorporate those Submissions into our Services without restriction, attribution, or compensation. You waive any moral rights or similar rights you may have in any Submission.
8. Third-Party Links and Services
The Site may contain links to third-party websites, applications, or services (for example, michigan.gov/mibridges, MDHHS websites, payroll providers, or background-check vendors). We provide these links for your convenience only. We do not control, endorse, or assume responsibility for any third-party content, products, or services, and we are not liable for any loss or damage arising from your use of any third-party site or service.
Your interactions with any third-party site or service are governed by that third party's terms and privacy policies, not ours.
9. Privacy Policy and HIPAA
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and share your information, and is incorporated into these Terms by reference. By using the Services, you agree to be bound by the Privacy Policy.
As an enrolled Michigan Medicaid Home Help provider, we are a covered entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and we handle Protected Health Information (“PHI”) in accordance with HIPAA and its implementing regulations. Our handling of PHI is described in Section 12 of our Privacy Policy. We will not use or disclose PHI for marketing purposes without a separate written HIPAA authorization that complies with 45 CFR § 164.508.
The Services are hosted in the United States. If you access the Services from outside the United States, you consent to the transfer of your information to and processing in the United States.
10. Electronic Communications and Signatures
By using the Services, sending us emails, submitting forms, or completing any electronic transaction with us, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, authorizations, and other communications we provide to you electronically satisfy any legal requirement that those communications be in writing.
You agree to the use of electronic signatures, contracts, orders, and other records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed by us or through the Services. You waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction that require an original (non-electronic) signature or the delivery or retention of non-electronic records.
This consent does not waive any requirements that may apply to HIPAA marketing authorizations or other documents that, by their nature or by applicable law, require additional formalities.
11. SMS Messaging
When you provide your phone number and consent to receive SMS messages from us, you agree to the terms of our SMS Terms, which are incorporated into these Terms by reference. You agree to receive eligibility inquiry follow-ups, program enrollment status updates, appointment and assessment reminders, caregiver onboarding notifications, and customer support SMS messages from us.
Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP or CANCEL to any message we send you. Reply HELP for assistance.
We will not share your mobile phone number, SMS opt-in consent, or SMS consent records with any third party or affiliate for marketing or promotional purposes, as further described in our Privacy Policy and SMS Terms.
12. Services Management
We reserve the right, but do not undertake the obligation, to:
- Monitor the Services for violations of these Terms or applicable law
- Take appropriate legal action against any person who violates these Terms or applicable law, including reporting such users to law enforcement or regulatory authorities
- Refuse, restrict access to, limit the availability of, or disable any portion of the Services
- Remove or refuse to post any content submitted through the Services
- Manage the Services in any manner designed to protect our rights, our property, and the rights of our users
13. Term and Termination
These Terms remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason or for no reason, including for breach of these Terms.
We may terminate your access to the Services, delete any information you have submitted, or take any other action we deem appropriate at any time and without warning.
If your access is terminated, you remain prohibited from registering or submitting forms under your own name, a false name, or the name of any third party.
Termination of these Terms does not terminate any rights or obligations that by their nature should survive termination, including provisions related to intellectual property, indemnification, limitations of liability, disclaimers, governing law, and dispute resolution.
14. Modifications and Interruptions
We reserve the right to change, modify, or remove the content of the Services at any time, for any reason, without notice. We have no obligation to update any information on the Site.
We do not guarantee that the Services will be available at all times. We may experience hardware, software, or other problems, or need to perform maintenance, that result in interruptions, delays, or errors. We may change, suspend, or discontinue any portion of the Services at any time without notice, and we will not be liable for any loss, damage, or inconvenience caused by your inability to access the Services during any downtime or discontinuance.
15. Disclaimer
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE OF THEM, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTY THAT:
- THE SERVICES WILL MEET YOUR REQUIREMENTS
- THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT
- ANY PARTICULAR ELIGIBILITY RESULT OR PROGRAM OUTCOME WILL BE ACHIEVED
WE ASSUME NO LIABILITY FOR:
- Errors, mistakes, or inaccuracies in any content
- Personal injury or property damage of any kind arising from your access to or use of the Services
- Unauthorized access to our servers or any personal information stored on them
- Interruption or cessation of transmission to or from the Services
- Bugs, viruses, or similar harmful code transmitted through the Services by any third party
- Decisions, denials, approvals, or authorizations issued by MDHHS or any other government agency
16. Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION, REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $1,000 USD.
Certain U.S. state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If those laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Mission Home Help, JTE Home Agency LLC, and our officers, directors, employees, agents, and affiliates from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party arising out of or related to:
- Your use of the Services
- Your breach of these Terms
- Your breach of any representation or warranty in these Terms
- Your violation of any third party's rights, including intellectual property or privacy rights
- Any false or fraudulent information you provide to us or to MDHHS through our Services
- Any harmful act you commit against another person in connection with the Services
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of those claims.
18. Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. The federal laws of the United States, including HIPAA and applicable Medicaid program rules, also apply where relevant.
19. Dispute Resolution
Informal Negotiations
Before initiating any formal dispute resolution, you and we agree to attempt to resolve any dispute, claim, or controversy arising out of or related to these Terms (each, a “Dispute”) informally for at least thirty (30) days. Informal negotiations begin when one party gives written notice of the Dispute to the other party.
Binding Arbitration
If the parties cannot resolve a Dispute through informal negotiations, the Dispute will be resolved by binding arbitration, except as expressly excluded below. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
The arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”), and where applicable, the AAA's Supplementary Procedures for Consumer-Related Disputes. The arbitration will take place in Oakland County, Michigan, or via remote proceedings if the parties agree. The arbitrator's award will be in writing and binding on the parties.
Class Action Waiver
To the fullest extent permitted by law, any arbitration or court proceeding will be conducted on an individual basis only. You and we waive any right to participate in a class action, class arbitration, or consolidated proceeding.
Exceptions
The following Disputes are not subject to mandatory arbitration:
- Disputes seeking to enforce or protect intellectual property rights
- Disputes related to allegations of theft, piracy, invasion of privacy, or unauthorized use
- Claims for injunctive relief
- Small claims court matters, where eligible
- Claims that cannot be subject to arbitration as a matter of law
Time Limit
Any Dispute must be commenced within one (1) year after the cause of action arose, except where a longer period is required by law.
Venue for Court Proceedings
If a Dispute proceeds in court rather than arbitration, the parties agree that the exclusive venue will be the state or federal courts located in Oakland County, Michigan, and both parties consent to the personal jurisdiction of those courts.
20. Corrections
The Site may contain information with typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct any errors and to change or update information on the Site at any time, without prior notice.
21. User Data
We will maintain certain data you transmit to us for the purpose of providing the Services. Although we perform regular routine backups of data, you are responsible for any data you transmit or that relates to any activity you conduct through the Services. You agree that we have no liability to you for any loss or corruption of data, and you waive any right of action against us arising from any such loss or corruption.
22. Miscellaneous
These Terms, together with the Privacy Policy and SMS Terms, constitute the entire agreement between you and us regarding the Services. Our failure to enforce any right or provision of these Terms does not waive that right or provision.
These Terms operate to the fullest extent permitted by law. We may assign our rights and obligations under these Terms to a third party at any time. You may not assign your rights or obligations under these Terms without our written consent.
We are not responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control, including natural disasters, acts of God, labor disputes, governmental actions, public health emergencies, or service-provider outages.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be severed from these Terms and the remaining provisions will remain in full force and effect.
There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms or your use of the Services. (This does not affect the W-2 employment relationship between Mission Home Help and caregivers we hire to provide Home Help services, which is governed by separate employment agreements.)
These Terms will not be construed against us as the drafting party. You waive any defenses based on the electronic form of these Terms or the lack of handwritten signatures.
